U.S. Citizenship and Immigration Services (USCIS) recently published additional frequently asked questions (FAQs) regarding the E-Verify Status Change Report and Employment Authorization Document (EAD) revocations. Employers are responsible for manually pulling this and need to add calendar reminders every two weeks to get updates to the EAD revocation page. These new changes place additional ongoing responsibilities for employers to monitor and act on this information promptly.   

On September 17, 2025, the public comment period closed on three regulatory proposals issued by the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP).  

On September 11, 2025, the Fourth Circuit heard oral argument in one of the first cases to challenge the constitutionality of the two clauses in Executive Order 14173 that have been nicknamed “the certification provisions.”    

In a unanimous Judgment, the SCOTUS resolved long simmering legal uncertainty by deciding that federal prosecutors may hold federal contractors and federal grant recipients criminally liable for fraudulently promising compliance in contract bid proposals even where the fraud caused no economic harm to the federal contract or grant agency. 

The proposed budgets are out for the fiscal year 2026 and it isn’t looking good for the Office of Federal Contract Compliance Programs (OFCCP). The budget plans of the U.S. Department of Labor’s (DOL) aim to fully eliminate the OFCCP beginning October 1, 2025.

The U.S. Department of Labor (DOL) announced their new Director of the Office of Federal Contract Compliance Programs (OFCCP) on March 24, 2025. Catherine Eschbach will now lead the department in its transition from EO 11246 to EO 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity. Eschbach is quoted as saying she will work to “restore a merit-based system to provide all workers with equal opportunity.”
