Illinois employers, mark your calendars! The clock is ticking for businesses with 100 or more employees in Illinois as of December 31, 2023, who are required to file an annual Employer Information Report EEO-1 with the U.S. Equal Employment Opportunity Commission (EEOC). By March 24, 2024 these employers must obtain an Equal Pay Registration Certificate (EPRC) to ensure compliance with state regulations.

Who Needs to Act: Private businesses meeting the employee count threshold in Illinois must secure an EPRC by the specified deadline.
Counting Employees: Employers should include both physically present and fully remote employees reporting to management in Illinois in their employee count.
Submission Requirements: Alongside the pay data template, employers must submit a compliance statement signed by an officer or executive. The registration fee is $150.
Application Process: Employers must create an Illinois Public ID Account to access the online portal for submitting application materials. If no due date has been provided by the Illinois Department of Labor (IDOL), the application must be filed by March 23, 2024.
Pay Analyses: Employers must certify that the compensation for female and minority employees is not consistently below that of male and non-minority employees within each EEO-1 job category.
