On Friday, June 27, 2025, OFCCP Director Catherine Eschbach issued a letter to all federal contractors with a voluntary request for information. The letter starts off by detailing the Executive Order changes that have occurred since January 21, 2025, focusing on the issuance of EO 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity, and the rescission of EO 11246 which mandated affirmative action requirements.
The OFCCP would like federal contractors to voluntarily:
- Provide information about how they wound down EO 11246 compliance and how they are complying with active non-discrimination laws
- Supply, in narrative form, what they are doing to comply with EO 14173
It is important to note that both requests are voluntary, and contractors have 90 days from June 27, 2025, to submit the information on the OFCCP portal if they so choose. What Should You Do?
It is unclear how the OFCCP plans to use the information submitted by contractors. The Department of Labor is planning to dismantle the OFCCP at the start of the next fiscal year, beginning October 1, 2025, leaving little time for submitted information to be analyzed.
We do not see any value in submitting this information to the OFCCP. If you feel compelled to submit, we recommend you consult with counsel and weigh the pros and cons to determine if it is in your company's best interest to submit this information.
The OFCCP Contractor Portal has been updated to include a free form text box where contractors can submit a narrative with any information they choose to provide. Contractors may also email OFCCP-ContractorPortal@dol.gov with their narrative or any additional documents related to their submission. The submission deadline is September 25, 2025, or five days before OFCCP is dismantled.
