Vehicles for pursing systemic investigations and examples of systemic discrimination are identified
The Equal Employment Opportunity Commission created a webpage, Systemic Enforcement at the EEOC, to identify the administrative and litigation tools used to pursue systemic discriminatory practices. It also explains how the agency determines what is systemic discrimination, how enforcement is effective, and details the process of initiating and conducting a systemic investigation.
EEOC defines systemic cases as “pattern or practice, policy and/or class cases where the discrimination has a broad impact on an industry, professional, company or geographic location.” The webpage identifies the following reports to assist them in addressing systemic discrimination.
- Advancing Opportunity A Review of the Systemic Program of the U.S. EEOC [2016]
- Improving Workplace Conditions through Strategic Enforcement, A report to the Wage and Hour Division [2010]
- Systemic Task Force Report to the Chair of the EEOC [2006]
