After several years of litigation, the Office of Federal Contract Compliance Programs (OFCCP) will be posting federal contractor EEO-1 race/ethnicity and gender data from 2016-2020 in response to a Freedom of Information Act (FOIA) request from the Center for Investigative Reporting (CIR). The data will be posted on February 25, 2026.

On November 18, 2025, EEO Leaders, an organization comprised of Democratic-aligned former EEOC and OFCCP officials, published a response (“EEO Leaders Response”) to the Department of Justice’s (“DOJ”) July 2025 Memorandum titled “Guidance for Recipients of Federal Funding Regarding Unlawful Discrimination.”

As non-essential government offices reopen, human resources, EEO, and compliance professionals in government contractor workplaces may want to generate a few priority to-do lists.   

The government shutdown is in its third week and human resource professionals find themselves in a tough spot. U.S. Citizenship and Immigration Services (USCIS) recently published additional frequently asked questions (FAQs) regarding the E-Verify Status Change Report and Employment Authorization Document (EAD) revocations. Employers are responsible for manually pulling this and need to add calendar reminders every two weeks to get updates to the EAD revocation page. These new changes place additional ongoing responsibilities for employers to monitor and act on this information promptly.   

On September 17, 2025, the public comment period closed on three regulatory proposals issued by the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP).  

On September 11, 2025, the Fourth Circuit heard oral argument in one of the first cases to challenge the constitutionality of the two clauses in Executive Order 14173 that have been nicknamed “the certification provisions.”
