Agency to change its compensation investigation practices to conform to Title VII legal principles

OFCCP Director Craig Leen issued a statement announcing that OFCCP will not be appealing its loss in the Oracle compensation case because he and the Solicitor of Labor “believe the likelihood of prevailing on appeal is low and because OFCCP no longer evaluates compensation in the manner rejected by the ALJ in this case.” Leen said that the agency has decided to change its compensation investigation practices to conform to Title VII legal principles that OFCCP failed to follow in the Oracle audit and litigation.

Oracle has also agreed to dismiss its case against the Department of Labor which challenged OFCCP’s enforcement authority. All pending audits on Oracle establishments that started prior to the lawsuit will be closed.
