The Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) released a finalized regulation called "Pre-enforcement Notice and Conciliation Procedures" on August 4, 2023.
This regulation, which will become effective starting September 5, 2023, bolsters the enforcement capabilities of the OFCCP. It achieves this by revoking the evidentiary criteria and explanations outlined in a preceding rule titled "Nondiscrimination Obligations of Federal Contractors and Subcontractors: Procedures to Resolve Potential Employment Discrimination," which came into force in December 2020. The OFCCP is hosting a webinar on the final rule via Webex on September 5, 2023.
