The Equal Employment Opportunity Commission (EEOC) set December 5, 2023, as the reporting deadline to submit and certify the mandatory 2022 EEO-1 Component 1 reports. However, EEOC announced that it is giving employers an extension until January 9, 2024. This "Failure to File deadline" will apply to any employer who missed the original December 5 deadline.
EEOC claims that after the January 9, 2024, no additional 2022 EEO-1 Component 1 reports will be accepted, and employers will be deemed to be out of compliance.
For the 2021 EEO-1 filing, EEOC sent out Failure to File notices to some companies who had completed and certified their reports. For this reason, OutSolve recommended and continues to recommend that employers maintain a copy of their certification and any responses from the EEO-1 filing system confirming completion of the reporting.
