EEOC Issues Delayed Failure to File EEO-1 Notices | OutSolve Blog

Employers are receiving Failure to File notices from EEOC for certified submissions

As a reminder, the 2021 EEO-1 Component 1 data collection is currently open. Employers have through Tuesday, June 21, 2022, to submit and certify their 2021 EEO-1 Component 1 report.

The OutSolve team has become aware of employers receiving a Failure to File notice and has previously submitted and certified their 2021 EEO-1 Component 1. If upon the time you received the Failure to File notice, and you have successfully submitted and certified your 2021 EEO-1 Component 1 submission you may disregard the letter.

Please note that the EEO-1 Filing system is experiencing delays in its processing operations. Employers are beginning to receive responses to support tickets requesting clarification of the Failure to File notice. This is an example response from the EEO-1 Component 1 Filer Support Team:

“Thank you for contacting the EEO-1 Component 1 Filer Support Team. You may ignore the Failure to File notices as they were delayed. According to our records, your company has completed and certified its 2021 EEO-1 Component 1 Data Collection report(s). Your filing obligation is fulfilled and no further action is needed at this time. If you need to contact the Filer Support Team regarding another matter, you can submit a new ticket through the message center at https://eeocdata.org/eeo1/signin.”

OutSolve recommends that you maintain a copy of your certification and any responses from the EEO-1 Filing system confirming completion and certification of your 2021 EEO-1 Component 1 reporting.
