Comment deadline extended to January 28, 2021

A notice was published in the Federal Register by OFCCP extending the public comment period to January 28, 2021 on its proposal to require federal contractors to submit an annual certification of their AAP compliance. OFCCP is seeking regulatory authority to have federal contractors annually certify that they have prepared AAPs via an online interface.

Additionally, OFCCP hopes to institute a secure method for contractors to submit AAPs in response to an audit notice. To accomplish this, OFCCP indicates that they will use an online platform, Affirmative Action Program Verification Interface (AAP-VI). AAP-VI will have five user interfaces, including an AAP upload interface and an annual certification interface. Instructions will be posted on the OFCCP website using AAP-VI user registration instructions provided in an email to contractors.

OFCCP may be extending the public comment period due to the fact that they only received 16 comments. Comments can be provided on the federal e-rulemaking portal.
