EEOC Gives Guidance to Third-Party EEO-1 Filers | OutSolve Blog

On February 2, 2022, the Equal Employment Opportunity Commission (EEOC) issued an update to assist third-party EEO-1 filers. The new procedures will likely impact third-party vendors like ADP TotalSource, Insperity, Paychex, and the like. According to the EEOC, these updates will allow for more accurate employee demographic data in support of the agency’s mission to prevent and remedy unlawful employment discrimination and advance equal opportunity for all in the workplace.

What does this mean?

First, this new update does not affect OutSolve. We will continue to process client employers’ EEO-1 reports as required. However, since the EEOC’s process change prohibits bulk uploads, some third-party organizations plan to cease filing on their clients' behalf. Instead, they are offering resources for clients to file independently.

I use a PEO, ASO, or HRO. What should I do? 

OutSolve recommends checking with your third-party vendor so that you may prepare accordingly. If you are in need of EEO-1 support, please contact us and we can provide assistance. 

When is the deadline to file?

The opening of the 2021 EEO-1 Component 1 data collection is tentatively scheduled for Tuesday, April 12, 2022. The tentative deadline to file the 2021 EEO-1 Component 1 report is Tuesday, May 17, 2022. OutSolve is ready and available to assist employers with their EEO-1 reports as directed by the EEOC.
